These Terms & Conditions (“Terms”) govern your access to and use of the Inflyrax website, platform, services, campaigns, communications, and related features operated by Inflyrax (“Company”, “we”, “our”, or “us”). By accessing or using our services, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use of the platform immediately. --- 1. About Inflyrax Inflyrax is an influencer marketing and collaboration platform that connects brands, businesses, advertisers, creators, influencers, and digital marketers for promotional campaigns and marketing activities. Inflyrax acts solely as an intermediary platform unless explicitly agreed otherwise in writing. --- 2. Eligibility To use our services, users must: - Be at least 18 years old or meet the legal age requirement under applicable laws; - Have the legal authority to enter binding agreements; - Provide accurate, complete, and updated information. Inflyrax reserves the right to refuse access or terminate accounts that provide false or misleading information. --- 3. User Accounts Users are responsible for: - Maintaining account confidentiality and security; - All activities conducted through their accounts; - Providing accurate campaign, payment, and communication details. Users must immediately notify Inflyrax of any unauthorized account access or security breach. Inflyrax may suspend, restrict, or terminate accounts at its sole discretion for violations of these Terms, suspicious activities, fraud, abuse, or legal compliance reasons. --- 4. Platform Services Inflyrax may provide services including but not limited to: - Influencer campaign management; - Brand collaboration facilitation; - Creator discovery and outreach; - Campaign analytics and reporting; - Promotional and communication services. We reserve the right to modify, suspend, discontinue, or update any service, feature, pricing structure, or functionality at any time without prior notice. --- 5. Payments and Fees - Brands agree to pay campaign fees, service charges, taxes, and applicable costs as agreed. - Creators shall receive payments according to approved campaign terms and platform policies. - Inflyrax may charge platform fees, management fees, commissions, or transaction fees. - Delayed, disputed, reversed, or failed payments may result in campaign suspension, account restrictions, legal recovery actions, or permanent termination. Unless otherwise stated, all payments made to Inflyrax are non-refundable except as provided under the official Refund Policy. --- 6. Intellectual Property All platform content including branding, logos, software, website design, graphics, text, databases, and materials are the intellectual property of Inflyrax unless otherwise stated. Users may not: - Copy; - Reproduce; - Modify; - Sell; - Redistribute; - Reverse engineer; - Exploit platform content or technology without prior written permission. Users retain ownership of their original submitted content unless otherwise agreed contractually. --- 7. User Conduct Users agree NOT to: - Upload false, deceptive, or misleading information; - Violate intellectual property, copyright, trademark, or advertising laws; - Engage in fake engagement, fraudulent activity, impersonation, or scams; - Abuse, harass, threaten, or harm other users; - Use bots, scraping systems, or unauthorized automation tools; - Attempt to interfere with platform security or operations. Violation of these rules may result in immediate suspension, legal action, or permanent account termination. --- 8. Campaign Responsibility Inflyrax acts as a facilitation and management platform. Brands and creators are independently responsible for: - Campaign deliverables and deadlines; - Advertising disclosures and legal compliance; - Taxes, invoices, and financial reporting; - Product claims and promotional statements; - Content accuracy, authenticity, and legality. Inflyrax does not guarantee campaign performance, sales results, engagement metrics, audience growth, or business outcomes. --- 9. Limitation of Liability To the maximum extent permitted by law, Inflyrax shall not be liable for: - Indirect, incidental, or consequential damages; - Revenue loss, profit loss, or business interruption; - Creator misconduct or client disputes; - Third-party platform outages, bans, restrictions, or algorithm changes; - Data loss, unauthorized access, or cyber incidents; - Delays caused by users, creators, payment processors, or external service providers. Use of the platform is entirely at the user’s own risk. --- 10. Indemnification Users agree to indemnify, defend, and hold harmless Inflyrax, its owners, employees, affiliates, and partners from any claims, damages, liabilities, losses, legal actions, or expenses arising from: - Violation of these Terms; - User-generated content; - Campaign disputes; - Legal or regulatory violations; - Fraudulent or unlawful activities. --- 11. Termination Inflyrax reserves the right to suspend, restrict, or terminate access to the platform without prior notice for violations of these Terms, suspicious activity, legal risks, or operational reasons. Termination does not remove outstanding payment obligations or legal liabilities. --- 12. Force Majeure Inflyrax shall not be held responsible for delays, failures, or interruptions caused by events beyond reasonable control including natural disasters, internet failures, cyberattacks, government actions, strikes, pandemics, or third-party platform outages. --- 13. Governing Law and Jurisdiction These Terms shall be governed by and interpreted under the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh, India. --- 14. Policy Updates Inflyrax may revise or update these Terms at any time without prior notice. Continued use of the platform after updates constitutes acceptance of the revised Terms. --- 15.
